Terms of Service

1. Agreement

By accessing or using Vardeck ("the Service"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these terms.

2. Service Description

Vardeck provides cloud-based compliance management software for UK leisure facilities, including pool water testing, equipment management, incident reporting, staff management, and swim lesson administration.

3. Accounts and Access

• You are responsible for maintaining the confidentiality of your account credentials
• You must notify us immediately of any unauthorised access
• You must not share login credentials between users
• Each user must have their own individual account

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorised access to any part of the Service
• Upload malicious code or attempt to compromise the Service's security
• Use the Service to store data unrelated to leisure facility management
• Exceed your plan's usage limits

5. Data Ownership

You retain ownership of all data you input into the Service. Vardeck acts as a data processor on your behalf. Upon termination, you may export your data within 30 days. After this period, your data will be permanently deleted.

6. Service Availability

We aim for 99.9% uptime but do not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance. We are not liable for downtime caused by factors outside our control.

7. Subscription and Payment

• Subscriptions are billed monthly or annually as selected
• Payments are processed securely via Stripe
• Prices are in GBP and exclusive of VAT unless stated otherwise
• Failed payments may result in service suspension after a grace period
• Refunds are handled on a case-by-case basis

8. Limitation of Liability

To the maximum extent permitted by law, Vardeck's liability is limited to the fees paid by you in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

The Service does not replace professional health and safety advice. You remain responsible for compliance with all applicable regulations.

9. Termination

Either party may terminate the agreement with 30 days' written notice. We may suspend or terminate your account immediately if you breach these terms. Upon termination, your right to use the Service ceases and data export provisions apply.

10. Changes to Terms

We may update these terms from time to time. Material changes will be communicated 30 days in advance. Continued use of the Service after changes constitutes acceptance.

11. Governing Law

These terms are governed by the laws of England and Wales. Disputes shall be subject to the exclusive jurisdiction of the English courts.
